06-06-2017: HEADLINE: Is ARWS (RWA of Sector A, Pocket B & C) a proprietorship company or is it a registered and functional RWA?
Today was a hearing of the complaint filed in the District Consumer Disputes Redressal Forum Qutab Inst. Area, New Delhi by Mrs. Achla Bhandari against Mr. Ashok Saxena the Secretary of ARWS and Mr. Amit Aggarwal the Executive Member of ARWS of Sector A, Pocket B & C.
As Mrs. Achla Bhandari was out of town for some time she had requested Mr. Dhruv Khosla a senior team member of JAF Vasant Kunj to be present on her behalf for which she has given Mr. Dhruv Khosla a authority letter.
Mr. Dhruv Khosla reached on time (11 am) for the hearing to find that neither Mr. Ashok Saxena nor Mr. Amit Aggarwal had arrived. After waiting for almost 20 minutes Mr. Amit Aggarwal arrived and informed the Forum that Mr. Ashok Saxena will not be coming as he is out of the country. Upon being inform of this the Forum asked Mr. Dhruv Khosla if it is acceptable that the Forum gives a future date for the hearing. In the interest of justice Mr. Dhruv Khosla agreed for another date so that Mr. Ashok Saxena can also attend. When the Forum asked Mr. Amit Aggarwal as to when Mr. Ashok Saxena will be back he said “I don’t know” to which the Forum suggested a date towards the end of August. Mr. Amit Aggarwal then said that a date in September would be much more suitable. While the Forum was trying to check their system for a available date in the month of September an argument broke out between Mr. Amit Aggarwal and Mr. Dhruv Khosla on the matter of the complaint. The Forum coordinator came forward and asked if you people really want to discuss this here and now “Mai aap dono ko andar bhaje du” both agreed and were directed into the mediation room.
The Honourable Mediator noted the names of the people present and asked Mr. Amit Aggarwal why Mr. Ashok Saxena is not present for the hearing. Mr. Amit Aggarwal informed that Mr. Ashok Saxena if out of the country and will be back in 3-4 months. The Honourable Mediator made a note of this in the case file and asked Mr. Dhruv Khosla to spell out the complaint. Mr. Dhruv Khosla informed The Honourable Mediator that “I am a resident of Sector A Pocket B & C and also a Block Representative and that I have also been in the executive committee of the ARWS in the past. I was unable to attend the last GBM held on 16.4.2017 due to an eye operation. Later on I got to know that Mr. Ashok Saxena the Secretary of ARWS and Mr. Amit Aggarwal the Executive Member of ARWS had passed some very defamatory and derogatory remarks against me, furthermore these were also recorded in the Minutes of the Meeting. I approached Mr. Arvind the manager of ARWS for a copy of the minutes of the meeting but he refused to give me a copy stating that he does not have the authority to give me a copy. He suggested that I should ask Mr. Ashok Saxena the Secretary of ARWS and Mr. Amit Aggarwal the Executive Member of ARWS for a copy.”
The Honourable Mediator asked Mr. Amit Aggarwal to hand over a copy of the minutes of the meeting to Mr. Dhruv Khosla. Mr. Amit Aggarwal informed The Honourable Mediator that he does not have a copy. The Honourable Mediator asked him “then who has a copy” to which Mr. Amit Aggarwal said Mr. Ashok Saxena will be having a copy. The Honourable Mediator said “you have just informed me that Mr. Ashok Saxena is not available for 3-4 months, you expect Mr. Khosla to wait for 3-4 months” Mr. Amit Aggarwal arrogantly told The Honourable Mediator that ARWS has sent a copy to the Registrar of Societies and that Mr. Khosla can file an RTI and get a copy. Before Mr. Dhruv Khosla could react The Honourable Mediator asked Mr. Amit Aggarwal “you mean to say that every resident should file a RTI to get a copy of the Minutes of the Meeting of a GBM” The Honourable Mediator demanded from Mr. Amit Aggarwal to give him the names and addresses of the other people of ARWS like the President, Vice-President, Treasurer etc. so that he can send them a notice to appear before the Forum and hand over a copy of the Minutes of the Meeting to Mr. Dhruv Khosla. Mr. Amit Aggarwal’s reply to this demand of The Honourable Mediator was a astonishing revelation, he told The Honourable Mediator that there is no one else available for the next 3-4 months. The Honourable Mediator was shocked to hear this and asked Mr. Amit Aggarwal “is your ARWS a proprietorship company or is it a registered and functional RWA?” Mr. Amit Aggawral replied ARWS is very much a registered RWA. The Honourable Mediator instructed Mr. Dhruv Khosla to immediately write to the Registrar of Societies and inform them of this situation and also look into the records and validity of the ARWS. The Honourable Mediator further instructed Mr. Dhruv Khosla to send a copy of the letter to the Forum so that it can be filed for the record.
The Honourable Mediator made his nothings in the case file and informed both the parties to appear before the Forum on the 12th of September, 2017 at 12 pm. The Honourable Mediator once again reminded Mr. Dhruv Khosla to send the teller as instructed to the Registrar of Societies and submit a copy the Forum.
